Sportweni Sports Academy Website Terms & Conditions and Privacy Policy
Any dispute that occurs between Sportweni and any person using this website or the courses/facilities shall be subject to and determined in terms of the laws of South Africa. All reference to Sportweni will by default include, inter alia, the property, owners, staff and management as well as any suppliers or contractors employed by Sportweni who may be part of the business and its functions.
Use of the online facility is subject to the following terms and conditions:
1. Website usage
The use of this website, the booking facility (application form) or bookings made through the online booking facility and the use of the accommodation and facilities offered by Sportweni are subject to these terms and conditions. By using this website or by making a booking through theonline booking facility or application form, you consent to these terms and conditions.
2. Website access is subject to Sportweni discretion
Access to this website may be restricted or refused by Sportweni at its sole discretion. Sportweni does not guarantee that this website will be accessible at all times.
3. Intellectual Property
All images, text, information and designs, whether registered or unregistered, are the intellectual property of or licensed to Sportweni and may not be used without Sportweni prior written consent. Any unauthorised use may result in prosecution.
4. Accuracy of Information
Although Sportweni endeavours to maintain accurate information on the website at all times, Sportweni shall not be liable for any damages suffered as a result of inaccurate information on this website. Any payments made to Sportweni in respect of incorrect booking details by Sportweni will be refunded.
5. Warranty and exclusion of liability
By using this website you warrant that all information supplied by you is correct and accurate. You hereby indemnify Sportweni against any damage suffered or liability incurred by Sportweni as a result of incorrect information supplied by you.
6. Payments, cancellation policy and arrival/departure times
A booking is only confirmed upon receipt of payment of R 5,000.00 of the total charge in respect of that booking, by Sportweni. Should a R 5,000.00 deposit not be made within 48 hours from submission of the booking request, Sportweni shall be entitled to cancel your provisional booking and make it available to other customers.
Once a booking has been confirmed, the following cancellation fees shall apply:
- Cancelled less than 60 days prior to arrival : 30% of the full accommodation charge
- Cancelled less than 30 days prior to arrival : 50% of the full accommodation charge
- No Show bookings : 100% of the full accommodation charge
All additional charges must be settled prior to departure;
All rates quoted include 15% VAT;
Check in is between 14h00 and 18h00 – arrangements need to be made if you will be arriving after 18h00.
Departure is before 10h00.
It is your responsibility to ensure that a payment was successful and that a booking is confirmed. Sportweni accepts no responsibility or liability in regard to transactions for which you are unable to provide a confirmation of booking.
7. Use of Premises/Facilities
The premises/facilities shall be used at all times in a manner that is acceptable to Sportweni and other guests/visitors and that doesn’t cause or allow damage to the premises/facilities. Sportweni reserves the right to refuse any person access to the premises/facilities, in its sole discretion and irrespective of a valid confirmation of booking, if that person acts in a manner which is unacceptable to Sportweni.
8. Liability
Sportweni shall not be responsible for any damage to or loss of personal property nor for the death of or injury to any persons or any guests on the property.
9. Privacy Policy
Any and all information submitted by you through this website or to Sportweni otherwise will be dealt with in the strictest confidence and safely stored. Sportweni reserves the right (unless expressly denied) to use the information supplied for promotional purposes, but no information shall be shared with third parties.
10. Representations
The descriptions, photos and other representations made on this website should not be construed as a guarantee of the state of facilities. No expectation created through the representations on this website shall impose any responsibility or liability on Sportweni.
11. Force majeure
Sportweni shall not be responsible if it is unable to supply the services booked and/or paid for if performance becomes impossible due to force majeure. The cancellation policy as set out above shall apply to such circumstances, the date of the performance becoming impossible being the date of cancellation.
12. Changes to website contents
Sportweni reserves the right to amend the contents of this website, including these terms and conditions, without any notice to you. The term and conditions applicable on date of confirmation of a booking shall be applicable to that booking.
